Election

The Election of the Bhubaneswar Bar Association shall be held on 2nd March of every year and if the day is a holiday, then the election will be held on the next working day. The Executive Committee shall notify the name of 3 (Three) members as the Election Officers out of which one Chief Election Officer (having minimum 25(Twenty five) years of having been in the roll of the Bar Association) and Two numbers Assistant Election Officer (having been minimum 20(Twenty) in the roll of the Bar Association), not less that 30(thirty) days prior to the date of Election i.e. Annual General Body Meeting Date.

Upon such appointment (The election officer shall proceed to the following:
  • To invite nominations for the posts enumerated Ci 6(i), to be checked such notice shall be in clear 15 Calendar days in advance of the appointed day of the election, allowing 7 days time for receipt of nomination, papers duly proposed and seconded by members in the prescribed pro-forma. The election officer should scrutinize the nomination-papers on an appointed date and time not exceeding forty eight hours of close acceptance of nomination in the presence of the candidates or their authorized agent.
  • Upon completion of process as enumerated in the above clause the election officer shall publish the valid list of the candidates within twenty four hours.
  • The election officer shall allow two days time thereafter for withdrawal of candidature, if any, to be communicated by the nominee in writing seeking election. Thereafter the election officer shall publish the final list of the candidates within 24 hours from withdrawal. Provided that due regard shall be paid to the fact that such notices as stipulated above shall be given within normal working hours of the court, further provides the valid list of voters shall be made available to the election officer and the election officer shall within three days after receipt shall cause its publication giving 3 days for objection and correction if any. No contesting candidates shall influence the voters by offering presentations, gifts, donations, arranging get-together and provide cook food in the day of election.
  • Election officer has the power to restrict for posters, Banners and walling etc. at the time of election and any time also for smooth functioning of election except from visiting card. So also he should take care of that no contesting candidates shall influence the voters by offering presentations, gifts, donations, arranging get together and providing cook food during the process of election.
  • BALLOTPAPER: The ballot paper shall be provided by the election officer and it shall be in the alphabetical order. *
  • The Election Officer shall declare the Result of the Election after counting it in presence of the candidates or Authorized agent in writing duly signed and notified immediately and issue letter to the Registrar, Civil Court, Khurda; Chairman, Bar Council of Orissa; and G A. Department, Govt of Orissa, intimating the result of the election with the names of the newly elected Office Bearers.
  • VOTER LIST: Secretary shall handover the list of valid voters to— the election officer and publishes the list in the Notice Board inviting objection / addition / rectification of defect etc. if any. A member admitted after the appointment of the Election Officer shall have no power or right to cast his vote in the election of concerned year.The final voter list shall be published on or before the date of nomination on the joint signature of the Secretary and Election Officer. Except Secretary of the Association, no one is authorized to collect outstanding dues of the members.
  • OATH TAKING CEREMONY & CHARGE HANDOVER: There shall be an Oath Taking Ceremony of. the newly elected Office Bearers of the Association on the Working Day following the Day of Election. The outgoing Office Bearers shall handover all the properties, viz: Membership Register, Membership Documents, and Money Receipts (Used &. Unused), Resolution Register, Fixed Deposit Documents, Assets List, Bank Passbooks & Cheque Books' etc. to the newly elected Office Bearers immediately within two days after Oath Taking Ceremony, failing which, the General Body shall take action (Civil & Criminal) against the defaulted outgoing Office Bearers.
