Removal of Members

Any member indulging in a manner not befitting a member of the association, or in its contravention of its objects, rules regulation or the code of conduct from time to time laid down shall be liable to be removed from the roll of members or censured or otherwise dealt with by the Executive Committee, provided that no person shall be removed from the roll of members under this rule unless the decision of the Executive Committee regarding removal is approved by the General voting by a special resolution supported by at least two third of the members present.

A Disciplinary Committee shall be constituted consisting of 5 (five) members and the same shall be headed by a Chairman from amongst the 5 (five) members basing on seniority. The President and Secretary of the Executive Body shall be the members of the Disciplinary Committee. The tenure of the committee shall continue till tenure of the Executive Committee.

MISCONDUCT BY A MEMBER :
  • Committing fraud, impersonation or any other offence.
  • Acting or involvement against the interest of the Association.
  • Any other misconduct as defined as per Advocate's Act

CHARGES:
  • The due charges framed against delinquent member shall be served by the Executive Body through Secretary of the Association.
  • The Delinquent member shall submit his explanation within 7 days from the date of receipt of Charges.

PROCEEDING
  • The Disciplinary Committee shall complete the proceeding within 15 days from the date of reference by the Executive Committee and submit the recommendation to the Executive Committee.
  • The Executive Committee on receipt of recommendation from the Disciplinary Committee shall supply a copy of it to the Delinquent member to submit his/her Show cause by serving a Notice of 7 (Clear days).
  • On receipt of the Show Cause the Executive Committee shall deliver its verdict within 15(fifteen days).

APPEAL
  • The Delinquent member found guilty of misconduct may prefer an Appeal within 15(Fifteen) days to the General body and the said appeal memo shall be served to the President/ Secretary of the Association.
  • The President/Secretary of the Association shall convene a special General Body meeting for the consideration of appeal and disposal thereof within 15 clear days, from the date of receipt of appeal.
  • In Case the General Body confirms the verdict delivered by the Executive Committee, the copy of the confirmation shall be communicated to the Orissa State Bar Council for information.
